Food preparation and cooking outside of an enclosed food establishment is prohibited under the California Uniform Retail Food Facilities Law (CURFFL) Section 114145* , except for a barbecue which is constructed and operated pursuant to Article 9 (beginning with Section 114185.)

Methods of cooking which do not involve roasting or broiling of food over live coals (wood, charcoal, or gas heated) on a grill, spit, or in a pit are not included under Article 9. The fact that a piece of heating equipment may use propane gas or solid fuel does not entitle the operator to use the Article 9 exemption unless the food is prepared over live coals on a grill or spit.

It should be pointed out that serving and consumption of food outdoors is not prohibited. Outdoor seating at restaurants and other food facilities is common. It is also permissible to offer samples of food items prepared in the establishment to passersby for the purpose of enticing new customers.

* Each food establishment, except produce stands and swap meet prepackaged food stands, shall be fully enclosed in a building consisting of floors, walls, and an overhead structure that meet the minimum standards prescribed by this chapter.
