Below are summaries of California's current laws governing lead poisoning prevention and pertinent regulations that implement those laws.
    California laws, also referred to as "statutes", are enacted by the State legislature, through passage of Assembly or Senate bills.

    California regulations, also referred to as "standards", are written and filed, by one or more State programs, in response to a law/statute. Regulations/Standards serve to implement the mandates of a law/statute. In other words, regulations/standards establish the detailed requirements for doing what the law/statute requires.

  • Lead Hazard Reduction Enforcement

    Senate Bill 460 - Frequently Asked Questions
    This bill was designed to provide the Department of Health Services and local enforcement agencies the authority to issue orders to abate or otherwise correct a lead hazard.
    Assembly Bill 2861 - Complete Text
    This bill was designed to clarify and increase the penalties related to orders to abate lead hazards.

  • Childhood Lead Poisoning Prevention Act
    California Health & Safety Code 105275 to 105310
    This law establishes the Childhood Lead Poisoning Prevention Program within the California Department of Health Services and requires them to compile information, identify target areas and analyze information to design and implement a program of medical follow-up and environmental abatement to reduce childhood lead exposure.

  • Reporting of Elevated Blood Lead Levels
    California Health & Safety Code 124125 to 124165
    This law declares childhood lead exposure as the most significant childhood environmental health problem in the state. It mandates medical laboratories to report cases of children with elevated blood lead levels. It mandates childhood lead poisoning prevention activities be established by the Department of Health Services, including identification and selection of target areas for childhood lead screening programs, field trials of alternative lead abatement technologies, implementation of a program to identify and follow-up high risk children, provision of environmental abatement and continued programs to reduce the incidence of excessive childhood lead exposure.

  • Occupational Lead Poisoning Prevention
    California Health & Safety Code 105185 to 105195
    These laws establish an occupational lead poisoning prevention program to register and monitor laboratory reports of adult lead toxicity cases, monitor reported cases of occupational lead poisoning to ascertain lead poisoning sources, conduct investigations of take-home exposure cases, train employees and health professionals regarding occupational lead poisoning prevention, and recommended means for lead poisoning prevention.

  • Lead Accreditation and Certification Program
    Health & Safety Code 105250
    This law establishes a program to accredit lead-related construction training providers and certify individuals to conduct lead-related construction activities.

  • Lead in Children's Toys
    Health & Safety Code 108550 to 108580
    This law prohibits the manufacture, sale or exchange of toys with lead content in excess of the amount permitted by federal regulations.

  • Lead Exposure Screening
    Health & Safety Code 1367.3 to 1374.35
    This law requires blood lead screening for children covered by health insurance.
  • Lead-Safe Schools Protection Act
    Education Code 32240 to 32245
    This law implements a lead poisoning prevention and protection program for California schools to survey and ascertain risk factors that predict lead contamination in public schools. It establishes guidelines for notification and advisement regarding survey findings, utilization of state certified workers for activities to remediate lead-hazards and prohibits the use of potential sources of lead contamination in public schools.
  • Lead-Related Activities in Construction Work
    Labor Code 6716 to 6717
    This law provides for the establishment of standards that protect the health and safety of employees who engage in lead-related construction work, including construction, demolition, renovation and repair.
  • Real Estate Disclosure Requirements
    Civil Code 1102 to 1102.16
    This law requires the disclosure of known lead-based paint hazards upon sale of a property.
